On his community website, “AmericanaWhen.com, fellow Villager, Clark Vernon, states that Hot Springs Village has had “four untrustworthy regimes in 10 years and [is] still waiting for proper responsive management and a Board that serves the People!”.
Vernon also goes on to say, “unfortunately, the Board is at it again.”
“The last time the property owners were shown any respect was over 10 years ago when CCI was still in control. “
In a five-step process, Vernon outlines what he feels needs to be done. This starts with Property Owners being accorded their due respect and putting in place a method to help keep Board Directors accountable for their actions with a way to recall a Board Director.
In step one, Vernon explains that respect can start by striking the word ‘MEMBERSHIP’ from the Village POA vernacular and replacing it with ‘PROPERTY OWNERS.’ The use of the word ‘membership’ or ‘member’ “was Manager Twiggs’s ploy to reduce the Property Owners’ perception of themselves and as the theory goes – make us more manageable. Give the Property Owners the right to recall Directors out-of-step with the ownership. Give the owners the first-ever “Control Audit” as defined in Sarbanes Oxley. Give ‘say so’ back to the owners over large expenditures. Give the owners an ‘Honest’ review to include expense control before asking for more money.”
“‘Membership’ is not ‘Ownership’. If I can by frequent use of the term convince you that you are a ‘Member’, then I’m successful if I am trying to exert control over you. ‘Ownership’ conveys substantially more rights in the general scheme of things. Including the right not to be controlled as a mere ‘Member’.”

Correct. We cannot trust the board in its current makeup and configuration nor can we continue to operate with bylaws as they are currently structured. Governance and management must change before we commit to new money.

I think he should take his own advice and “stick it” and then leave. He thinks he has solution but is not capable of making anything happen.
All just noise. He has lots of it.
My guess he will continue to pontificate, and it will get the attention it deserves. NONE.

Passing the Ark. Nonprofit Act of 1993 (ACA 4-33-101 et al) would be a good start to trusting the BOD again. It allows for removal of a director or all the directors with or without cause. It also enables property owners to have a voice in a number of areas.
It won’t solve all our problems but it’s a good first step.—Gene

New fee for windshields stickers for gate entry went from 0$ to $10. How many were sold? What was the revenue increase? How was it spent? Could we get an audit by golf course? Which are not self supporting? Close those that do not support staying open.
Audit other POA projects/initiatives/management practices and make changes needed. Lay-off if necessary excess employee/management base. Make cuts within, not assessment increase to property owners.
As a retired DoD Program Analyst, given this current assessment increase, I would ask the Portfolio and Project Manager to justify the budget increase by recommending three courses of Action (COA’s), and one most recommended with cost adjustments to show total current costs versus total increased cost by each area of work in their management to be approved by Property Owner’s. If The Board can’t manage properly let Property Owner’s vote on it. If the Manager cannot justify their budget increase, then the answer must be NO!
And, relative to any dart throwing in previous comments, that does nothing to help fix a problem. If You want to comment, please provide your recommended fixes.

I see Nally got $280,000 more than She should because of a POA Board FUBAR in not notifying Her that contract would not be renewed. Way too go Board! Her contract was not enforceable as I have previously stated because the contract had an illegal clause in it, e.g. “Her bonus would be paid as as part of Her salary so that taxes would no have to be paid.” That is an illegal clause! Did a business contract lawyer review that?
We need someone that knows how to manage contracts!
